Terms of Service

1. Acceptance

By accessing or using Kola Billing, you agree to these Terms of Service and our Privacy Policy. If you use the service for an organisation, you confirm that you are authorised to accept these terms for that organisation.

2. Accounts and authorised users

You must provide accurate account information, protect login credentials and restrict access to authorised users. You are responsible for activity performed through your account and for configuring roles, branches and permissions appropriately. Notify us promptly if you suspect unauthorised access.

3. Permitted and prohibited use

You may use Kola Billing for lawful business billing, accounting, inventory, reporting and communications. You must not:

• Use the service for fraud, unlawful activity, harassment, spam or deceptive messaging.
• Access another organisation’s information without authority.
• Interfere with service security, availability or access controls.
• Upload malicious code or attempt to reverse engineer protected service components except where law expressly permits.
• Use the service in a way that violates third-party rights or platform rules.

4. WhatsApp and electronic communications

When using the WhatsApp integration, you are responsible for maintaining a valid WhatsApp Business Account, approved message templates, accurate recipients and all required consents. You must comply with Meta’s WhatsApp Business and Commerce policies, applicable privacy rules and messaging laws.

Delivery depends on Meta and recipient networks. Kola Infotech-Billing cannot guarantee that a message will be accepted, delivered or read.

5. Business records and compliance

You control the business data entered into Kola Billing and are responsible for its accuracy, legality and retention. Reports, tax calculations and workflow controls are operational tools and do not replace professional accounting, tax or legal advice. You should review documents before issuing or filing them and maintain any records required by law.

6. Fees and third-party services

Any agreed subscription or service fees must be paid according to the applicable order or plan. Cloud hosting, WhatsApp, email, payment or other third-party services may impose separate charges and terms. Third-party services are controlled by their providers.

7. Availability, changes and support

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security events, internet failures and third-party outages may affect access. We may update features to improve security, compliance or functionality and will use reasonable efforts to avoid material disruption.

8. Intellectual property

Kola Infotech-Billing and its licensors retain rights in the service, software, design and documentation. You retain rights in your business data and grant us permission to process it only as needed to operate, secure and support the service.

9. Suspension and termination

Access may be suspended when reasonably necessary to address security threats, unlawful use, material breach or unpaid fees. You may stop using the service and request account deletion. Some records may be retained where required by law, legitimate dispute resolution or backup cycles.

10. Disclaimers and liability

To the extent permitted by law, the service is provided on an “as available” basis. Kola Infotech-Billing is not liable for indirect, incidental or consequential loss, loss of profits, third-party platform failures or decisions made solely from generated reports. Nothing in these terms excludes liability that cannot legally be excluded.

11. Governing law

These terms are governed by the laws of India. Disputes that cannot be resolved informally will be subject to the jurisdiction of competent courts in India, unless applicable law requires otherwise.
